These Terms cover the Backwatch website and any Backwatch-hosted scan or monitoring feature that we make available. The backwatch command-line program is open-source software released under the MIT License; that license governs use of the code. These Terms do not replace or expand the MIT License.
1. Operator and acceptance
Backwatch is operated by the same operator as Wisprs (wisprs.co). In these Terms, “Backwatch”, “we” and “us” mean the Backwatch service and its operator. By using the website or a hosted Backwatch feature, you agree to these Terms. If you use the service for an organization, you confirm that you can accept these Terms for it.

2. What Backwatch does
Backwatch checks publicly reachable websites and MCP servers for technical properties related to agent readability, discovery, connection and presence. Reports are automated observations at a point in time. They may be incomplete, become stale, or be wrong. A score is not a security audit, compliance opinion, endorsement, guarantee of availability, or guarantee that an AI host will find or use a service.
The hosted monitor, accounts, paid plans and alerts are not available unless and until we announce them. Any prices or features described as planned are informational only; nothing is currently offered for purchase. We will publish additional terms before accepting payment or providing account-based monitoring.
3. Permission and public scanning
Only submit a website or server you own or are authorized to test. You are responsible for having permission for every target and for respecting applicable laws, contracts, rate limits and third-party rights. Do not submit private, authenticated or sensitive URLs.
When the public scanner is enabled, scans are public by default. You agree that the resulting report, submitted origin, score, verdict and scan time may be displayed on Backwatch pages, including recent scans and a leaderboard. A public report may be copied or indexed by third parties. Use /remove to request that a site be suppressed; suppression from Backwatch does not remove third-party copies. We may remove or unlist reports to address abuse, a valid request, a legal obligation or an operational issue.
The scanner makes bounded requests to public HTTP and HTTPS endpoints using Backwatch's documented checks. It does not log in, use credentials, execute code from the target, or call MCP tools. A scan can still create traffic and appear in the target's logs. You are responsible for choosing whether to submit a target.
4. Acceptable use
You must not use the website or hosted features to:
- scan a target without authorization or use the service to harass, intimidate or mislead a site owner;
- attempt to bypass authentication, access private systems, exploit vulnerabilities or disrupt a service;
- send a volume or pattern of requests intended to degrade a target or Backwatch;
- submit unlawful, harmful or infringing material, or information you have no right to disclose;
- interfere with service security, rate limits or other users; or
- use reports as the sole basis for a high-impact decision about a person or organization.
We may limit, suspend or block use that violates these Terms or threatens the service or another party.
5. Reports and intellectual property
You retain rights in information you submit. You give Backwatch permission to fetch the target you submit, generate a report, store it, and display it as described in the Privacy Policy and these Terms. You must have the rights and permissions needed to grant that permission.
Backwatch and its original materials are owned by the operator or its licensors. The CLI and other code identified as open source are governed by their stated open-source licenses. Nothing here transfers ownership of a target site or its content.
6. Privacy
Our handling of personal information is described in the Privacy Policy. Do not include secrets, personal data or confidential content in scan targets or removal-request notes.
7. Availability and changes
The website and hosted features are provided on a pre-release basis. We may change, suspend or discontinue a feature, report format or listing at any time. We do not promise uninterrupted availability, a particular check result, or that a report will remain available.
8. Disclaimers
To the extent permitted by law, the website, hosted scans, reports and scores are provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory. We do not warrant that a scan is complete, accurate, current, secure, or fit for a particular purpose. You decide whether and how to act on a report.
Nothing in these Terms excludes a consumer right or other protection that applicable law does not allow us to exclude.
9. Liability
To the extent permitted by applicable law, Backwatch is not liable for indirect, incidental, special, consequential, exemplary or punitive loss, loss of profits, data, goodwill, business opportunity, or service interruption arising from use of the website or a report.
To the extent permitted by applicable law, Backwatch's total liability for claims arising from these Terms or the hosted service is limited to the greater of the amount you paid Backwatch for the service in the 12 months before the event giving rise to the claim or US$100. If you paid nothing, the cap is US$100. This limit does not apply where applicable law prohibits it, including liability that cannot lawfully be limited.
10. Suspension and termination
You can stop using the service at any time. We may suspend or end access, or remove a report, for a breach of these Terms, a valid request, legal compliance, security, abuse prevention or operational reasons. Sections that by their nature should continue will survive termination.
11. Governing law and disputes
These Terms are governed by the laws of Delaware, United States, without regard to conflict-of-law rules, except that mandatory consumer protections in your country or state continue to apply. Before bringing a dispute, contact us at tosh@getwisprs.com and give us a reasonable opportunity to resolve it.
12. Changes and contact
We may update these Terms by posting a revised version and changing the "Last updated" date. Material changes will take effect on the date stated in the revised Terms. Continued use after that date means you accept the revised Terms, to the extent permitted by law.
